GENERAL TERMS AND CONDITIONS OF SALE

Welcome to the Maison LAU online store.

We recommend that you read the information below before making a purchase on the website www.maisonlau.com.

1. PURPOSE

These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the parties in connection with the online sale of jewelry offered by the Company to the Customer.

The Maison LAU website, accessible at www.maisonlau.com, is published by SAS Maison LAU, registered under SIRET number 930 838 024 00014.

These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between Maison LAU (hereinafter referred to as “the Company”) and any individual or legal entity (hereinafter referred to as “the Customer”) making a purchase via the website www.maisonlau.com (hereinafter referred to as “the Site”).

The Customer declares that they are at least 18 years old and have legal capacity, or have parental authorization allowing them to place an order on the Site.

By validating their order on the Site, the Customer accepts without reservation these GTCS, the prices, and the descriptions of the products offered for sale.

Maison LAU reserves the right to modify all or part of these General Terms and Conditions of Sale at any time without prior notice. In such cases, the applicable conditions will be those in force on the date the order is placed.

2. PRODUCTS

The products offered for sale are described and presented as accurately as possible. However, product photographs and descriptions are not contractually binding and may vary slightly due to the handmade nature of the products.

Due to the artisanal nature of our jewelry, items may differ slightly from one another and may present minor variations in shape, color, or length, which the Customer acknowledges and accepts.

Photographs illustrating the jewelry may also differ slightly from reality due to the Customer’s screen settings or lighting during photography.

Product Availability

The products offered for sale are those displayed on the Site on the day the Customer consults it, subject to availability. Availability is updated automatically in real time and indicated on each product page.

If, despite the Company’s vigilance, a product becomes unavailable, Maison LAU will inform the Customer by email as soon as possible.

However, any update error, regardless of its origin, shall not engage the Company’s liability.

Temporary or permanent unavailability shall not give rise to any compensation or damages for the Customer.

In the case of temporary unavailability, the Customer may subscribe to an email alert to be notified when the product becomes available again.

3. PRICES

Product prices are indicated in euros, all taxes included (VAT included), excluding shipping costs. They take into account the VAT applicable on the day of the order. Any change in the applicable VAT rate may be reflected in product prices.

Shipping costs will be indicated to the Customer before order validation and in the order confirmation.

The Company reserves the right to modify its prices at any time. However, products will be invoiced based on the prices in effect at the time of order validation, subject to availability.

Products delivered outside the European Union are not subject to VAT.

4. ORDERS

When a Customer wishes to make a purchase, they may click on a product to view its details. The product is then added to the shopping cart, which may already contain other selected items.

The Customer expressly declares that they have all necessary authorizations to use the chosen payment method.

It is possible that a Customer may receive a product previously returned by another customer. The Company only accepts returns of intact and unworn products, and these conditions are verified before restocking returned items.

5. PAYMENT

Payment is made online by credit card and must be completed in a single transaction. The order will only be considered accepted after payment validation.

The order amount is debited at the time of purchase on the Site.

Payment is processed via PayZen, which provides secure credit card transactions. The Company never has access to Customers’ banking details.

Cards issued by banks located outside France must be international bank cards. The Company reserves the right to cancel any order if the Customer’s IP address is located in a country different from the billing and/or delivery address.

Providing credit card information constitutes authorization to debit the Customer’s account for the total amount of the order.

The Customer agrees to ensure sufficient funds before placing any order. In the event of insolvency or payment cancellation, the Company reserves the right to suspend or cancel any order or delivery.

6. ORDER CONFIRMATION

A confirmation email is automatically sent to the Customer to confirm receipt of the order, provided the email address supplied is correct.

This email includes the order number, description of the products ordered, total amount including VAT, payment details, and shipping costs.

The Company reserves the right to cancel or refuse an order in the event of a dispute with the Customer regarding a previous order.

7. DELIVERY

Depending on the shipping method selected by the Customer:

Mainland France

Mondial Relay – Pickup Point (3–5 business days)
Dispatch within 2 business days, then 3–5 days transit
Rate: €4.50

Colissimo – Home delivery with signature
Dispatch within 2 business days, then 3–5 days transit
Rate: €10.50

Europe

Maison LAU currently delivers to the following countries:
Belgium, Germany, Italy, Spain

Mondial Relay – Home delivery (3–6 business days)
Dispatch within 2 business days, then 3–6 days transit
Rate: €15

Shipping costs are calculated and displayed before order validation.

Products are delivered to the address provided by the Customer. Delivery times are indicative, and the Company shall not be held liable for delays, including those caused by carriers.

Delivery times do not apply to pre-orders or customizable items.

Reasonable delays do not entitle the Customer to damages or order cancellation.

If the package is damaged upon delivery, the Customer must note precise reservations on the carrier’s delivery slip.

Delivery cannot be made to hotels or PO boxes.

If an error in the delivery address prevents delivery, the Company cannot be held responsible.

If a Colissimo delivery is missed, the package can be collected at the post office within approximately ten (10) days.

If an order is returned due to an invalid address or any reason attributable to the Customer, reshipping costs will be charged to the Customer.

8. TAXES AND CUSTOMS DUTIES

Displayed prices do not include potential customs duties or local taxes applicable upon import. These charges are the Customer’s responsibility.

The Company is not required to verify or inform Customers of applicable customs duties. Customers are advised to consult local authorities.

If the recipient refuses to pay customs duties, the Company cannot guarantee return of the parcel for reimbursement.

9. RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the French Consumer Code, the Customer has fourteen (14) days from receipt to exercise their right of withdrawal without justification or penalties.

Products must be returned in their original condition and packaging. Returned items must be new and unworn. Otherwise, no refund will be issued.

Return shipping costs are borne by the Customer.

Refunds (excluding shipping costs) will be issued within 14 days of receipt of the returned product.

The right of withdrawal does not apply to personalized items (e.g., engraving) or gift cards.

10. WARRANTY

Jewelry is guaranteed for 1 year from the purchase date, subject to proper use and compliance with care instructions.

Depending on the Company’s assessment and parts availability, the jewelry may be repaired.

The warranty does not cover normal wear and tear, improper use, negligence, accidents, modifications, or use of non-recommended cleaning products.

Except in the case of a proven manufacturing defect, shipping costs are borne by the Customer.

Claims must be submitted by email with details and photos. The Company may request return of the defective product before approving repair, replacement, or refund.

Repair times are approximately 8 to 10 weeks from receipt, depending on workshop activity.

11. LIABILITY

The Company shall not be liable for non-compliance with legislation in the country of delivery. The Customer must verify local import regulations.

The Company shall not be liable for failure or delay due to force majeure as defined by Article 1148 of the French Civil Code.

The Company is not liable for delivery disruptions, strikes, or IT-related issues, including hacking, technical malfunctions, site maintenance, data loss, software incompatibility, transmission errors, internet service failures, viruses, or malware.

The Customer is responsible for installing appropriate antivirus and security software.

The Company is only obligated to deliver products compliant with contractual provisions.

12. PERSONAL DATA

Information collected is necessary for order management and may be shared with contractual partners solely for order execution.

Maison LAU may also use technical means to collect non-personal information to improve site functionality.

13. INTELLECTUAL PROPERTY

Maison LAU is a registered trademark. All elements of the Site (texts, images, designs, models) are the exclusive intellectual property of Maison LAU.

No part of the Site may be reproduced, copied, sold, or exploited for commercial purposes without prior written authorization.

All copyrights, trademarks, and intellectual property rights remain the exclusive property of the Company.

In case of infringement, the Company reserves the right to pursue legal action and claim damages.

14. APPLICABLE LAW

These GTCS are governed by French law. In case of dispute, the parties agree to seek an amicable solution before initiating legal proceedings.
